User Agreement
1. General provisions
1.1. This User Agreement (hereinafter referred to as the "Agreement") applies to the website of the "MOYSHA" online store, located at www.moysha.com, and to all relevant websites associated with the www.moysha.com website.
1.2. The website of the "MOYSHA" online store (hereinafter referred to as the "Site") is owned by IP Filimonenko A.Yu.
1.3. This Agreement governs the relationship between the Administration of the website of the "MOYSHA" online store (hereinafter referred to as the "Site Administration") and the User of this Site.
1.4. The Site Administration reserves the right to change, add or delete clauses of this Agreement at any time without notice to the User.
1.5. The User's continued use of the Site signifies acceptance of the Agreement and any changes made to this Agreement.
1.6. The User is personally responsible for checking this Agreement for changes.
2. Definitions of terms
2.1. The terms listed below have the following meanings for the purposes of this Agreement:
2.1.1 "MOYSHA" - an online store located at the domain name moysha.com, which carries out its activities through the Internet resource and related services.
2.1.2. Online store - a website containing information about Products, the Seller, allowing to make a choice, order and/or purchase the Product.
2.1.3. Administration of the website of the online store - authorized employees who manage the Site, acting on behalf of the organization's name.
2.1.4. User of the online store website (hereinafter referred to as the "User") - a person who has access to the Site via the Internet and uses the Site.
2.1.5. Content of the online store website (hereinafter referred to as the "Content") - protected results of intellectual activity, including texts of literary works, their titles, prefaces, annotations, articles, illustrations, covers, musical works with or without text, graphic, text, photographic, derivative, composite and other works, user interfaces, visual interfaces, trade names, logos, computer programs, databases, and also design, structure, selection, coordination, appearance, general style and location of this Content, included in the Site, and other intellectual property objects, all together and/or separately contained on the website of the online store.
3. Subject of the Agreement
3.1. The subject of this Agreement is to provide the User of the online store with access to the Goods and services provided on the Website.
3.1.1. The online store provides the User with the following types of services (features):
• access to the search and navigation tools of the online store;
• access to information about the Goods and information on the purchase of Goods on a paid basis;
• other types of services (features) provided on the pages of the online store.
3.1.2. This Agreement applies to all existing (currently functioning) services (features) of the online store, as well as any subsequent modifications and additional services (features) that may appear in the future.
3.2. Access to the online store is provided on a free basis and is provided "as is."
3.3. This Agreement is a public offer. By accessing the Website, the User is deemed to have accepted the terms of this Agreement.
3.4. The use of materials and services on the Website is regulated by the norms of the current legislation of the Russian Federation.
4. Rights and obligations of the parties
4.1. The Site Administration has the right to:
4.1.1. Change the rules for using the Site, as well as change the content of this Site. Changes come into effect from the moment of publication of a new version of the Agreement on the Site.
4.1.2. Restrict access to the Site in case of User's violation of the terms of this Agreement.
4.1.3. Change the amount of payment charged for providing access to use the Internet store website. The cost change will not apply to Users who have registered at the time of the payment amount change, except for cases specially provided by the Internet store site Administration.
4.2. The User has the right to:
4.2.1. Access to use the Site after complying with the registration and payment requirements.
4.2.2. Use all available services on the Site, as well as purchase any Goods offered on the Site.
4.2.3. Use the Site exclusively for the purposes and in the manner provided for in the Agreement and not prohibited by the legislation of the Russian Federation.
4.3. The Site User undertakes to:
4.3.1. Provide upon request by the Site Administration additional information directly related to the services provided by this Site.
4.3.2. Respect the property and non-property rights of authors and other right holders when using the Site.
4.3.3. Not take actions that may be considered as disrupting the normal operation of the Site.
4.3.4. Not distribute, using the Site, any confidential and protected by the legislation of the Russian Federation information about individuals or legal entities.
4.3.5. Avoid any actions that may violate the confidentiality of information protected by the legislation of the Russian Federation.
4.3.6. Not use the Site for distributing advertising information without the consent of the Site Administration.
4.3.7. Not use the services of the Internet shop site for:
4.3.7.1. Uploading content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and (or) discrimination based on racial, national, gender, religious, social characteristics; contains false information and (or) insults addressed to specific individuals, organizations, authorities.
4.3.7.2. Inciting to commit illegal actions, as well as assisting persons whose actions are aimed at violating the restrictions and prohibitions in force on the territory of the Russian Federation.
4.3.7.3. Violating the rights of minors and (or) causing them harm in any form.
4.3.7.4. Infringing on the rights of minorities.
4.3.7.5. Pretending to be another person or a representative of an organization and (or) community without sufficient authority, including employees of this Internet shop.
4.3.7.6. Misleading regarding the properties and characteristics of any Goods from the catalog of the Internet shop posted on the Site.
4.3.7.7. Incorrectly comparing Goods, as well as forming a negative attitude towards individuals who do (not) use certain Goods, or condemning such individuals.
4.4. The User is prohibited from:
4.4.1. Using any devices, programs, procedures, algorithms, or methods, automatic devices or equivalent manual processes to access, acquire, copy, or track the content of the website of this online store;
4.4.2. Disrupting the proper functioning of the website;
4.4.3. Circumventing the website's navigation structure in any way to obtain or attempt to obtain any information, documents, or materials by any means that are not specifically provided by the services of this website;
4.4.4. Unauthorized access to the website's features, any other systems or networks related to this website, as well as any services offered on the website;
4.4.4. Violating the security or authentication system on the website or any network related to the website.
4.4.5. Conducting reverse searches, tracking, or attempting to track any information about any other user of the website.
4.4.6. Using the website and its content for any purposes prohibited by the legislation of the Russian Federation, as well as inciting any illegal activity or other activity that violates the rights of the online store or other persons.
5. Use of the online store website
5.1. The website and its content, which is a part of the website, belongs to and is managed by the website administration.
5.2. The content of the website cannot be copied, published, reproduced, transmitted or distributed in any way, and also cannot be posted on the global internet without prior written consent of the website administration.
5.3. The content of the website is protected by copyright, trademark law, as well as other laws related to intellectual property and unfair competition.
5.4. Purchasing products offered on the website may require the creation of a user account.
5.5. The user is personally responsible for maintaining the confidentiality of their account information, including password, as well as for all activities carried out under their account.
5.6. The user must immediately notify the website administration of any unauthorized use of their account or password, or any other breach of security.
5.7. The website administration reserves the right to unilaterally cancel a user account if it has not been used for more than 12 consecutive calendar months without notifying the user.
5.8. This Agreement applies to all additional terms and conditions regarding the purchase of Goods and provision of services offered on the Site.
5.9. The information posted on the Site should not be construed as a modification of this Agreement.
5.10. The Site Administration has the right to make changes to the list of Goods and services offered on the Site, as well as to the prices applicable to such Goods and services offered by the online store, at any time without prior notice to the User.
5.11. The documents specified in clauses 5.11.1 - 5.11.4 of this Agreement regulate the relevant part and apply to the User's use of the Site. The following documents are included in this Agreement:
5.11.1. Privacy Policy;
5.11.2. Public Offer;
5.11.3. Order Form;
5.11.4. Suggestions and Comments.
5.12. Any of the documents listed in clause 5.11. of this Agreement may be updated. Changes take effect from the moment they are posted on the Site.
6. Liability
6.1. The Administration of the website shall not be liable for any losses incurred by the User in case of intentional or careless violation of any provision of this Agreement, as well as as a result of unauthorized access to the communications of another User.
6.2. The Administration of the website shall not be liable for:
6.2.1. Delays or failures in the process of conducting transactions, caused by force majeure circumstances, as well as any malfunctions in telecommunications, computer, electrical and other related systems.
6.2.2. Actions of transfer systems, banks, payment systems and for delays associated with their work.
6.2.3. Proper functioning of the Website, if the User does not have the necessary technical means to use it, as well as does not have any obligations to provide users with such means.
7. Violation of the terms of the user agreement
7.1. The site administration has the right to disclose any information collected about the user of this site if disclosure is necessary in connection with an investigation or complaint regarding the unlawful use of the site or to identify the user who may violate or interfere with the rights of the site administration or the rights of other site users.
7.2. The site administration has the right to disclose any information about the user that it deems necessary to comply with applicable laws or court decisions, ensure compliance with the provisions of this Agreement, protect the rights or safety of the organization's name, or its users.
7.3. The site administration has the right to disclose information about the user if the applicable legislation of the Russian Federation requires or permits such disclosure.
7.4. The site administration has the right to terminate and/or block access to the site without prior notice to the user if the user has violated this Agreement or the conditions of use of the site contained in other documents, as well as in the event of the site's termination or due to technical malfunction or problem.
7.5. The site administration is not responsible to the user or third parties for the termination of access to the site in the event of the user's violation of any provision of this Agreement or other document containing the conditions of use of the site.
8. Dispute Resolution
8.1. In case of any disagreements or disputes between the Parties to this Agreement, a mandatory condition before going to court is the submission of a claim (a written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim, within 30 calendar days from the date of its receipt, notifies the claimant in writing of the results of the claim consideration.
8.3. In case it is impossible to resolve the dispute through voluntary settlement, any of the Parties may apply to the court for the protection of their rights granted to them by the current legislation of the Russian Federation.
8.4. Any claim related to the terms of use of the Site must be filed within 14 calendar days from the moment the grounds for the claim arise, except for the protection of copyright for materials protected in accordance with the legislation of the Site. In case of violation of the conditions of this clause, any claim or grounds for a claim are extinguished by the statute of limitations.
9. Additional Terms
9.1. The Site Administration does not accept counterproposals from the User regarding changes to this User Agreement.
9.2. User reviews posted on the Site are not confidential information and may be used by the Site Administration without restrictions.

4.4. The User is prohibited from:

7. Violation of the terms of the user agreement
7.1. 7.2. The site administration has the right to disclose any information about the user that it deems necessary to comply with applicable laws or court decisions, ensure compliance with the provisions of this Agreement, protect the rights or safety of the organization's name, or its users.
7.3. The site administration has the right to disclose information about the user if the applicable legislation of the Russian Federation requires or permits such disclosure.
7.4. The site administration has the right to terminate and/or block access to the site without prior notice to the user if the user has violated this Agreement or the conditions of use of the site contained in other documents, as well as in the event of the site's termination or due to technical malfunction or problem.
7.5. The site administration is not responsible to the user or third parties for the termination of access to the site in the event of the user's violation of any provision of this Agreement or other document containing the conditions of use of the site.
8. Dispute Resolution
8.1. In case of any disagreements or disputes between the Parties to this Agreement, a mandatory condition before going to court is the submission of a claim (a written proposal for voluntary settlement of the dispute).
